Wescot Credit Services Debt Collection Agents and
the Truth About Your Debt

You may question the validity of the debt by making a SAR (Subject
Access Request) in response to Wescot Credit Services debt collection
agents. The true owner of the alleged debt (the bank or the debt collecting
firm) is obliged to give you a true signed copy of your original credit
agreement if the contract was signed before 6 April 2007. If they do
not do this they are breaking the Consumer Credit Act, and the alleged
debt is said to be in dispute. While the debt is in dispute they are
not allowed to demand that you pay anything (if they do they are in
further breach of the act) and they are not allowed to sell it on (which
many do). While the debt is in dispute it cannot be enforced, even by
a court. There is a series of letters you can follow up after this.
If you want you can get a solicitor to do this for you, owing to the
difficulty of the law at certain points. There are also quite a few
legal and paralegal firms who have expertise in this field.
The chances are that they might ask you for your mobile number if
you have one (and most people do nowadays). But you should not give
it out to them. If you do they will phone you at work and at home at
any time of their choosing. They will continue to do this even after
you ask them to stop, so tell them in writing, and preferably send the
letter by registered post or recorded delivery to get a signature at
the other end (the problem is that so many operate from a PO box number
so a signature is impossible to get). Some of the worst debt collecting
companies (DCAs) will even stoop to contacting the people who live next
door to you and ask them if they know anything about your debt. The
worst will tell your kids that you are a bad parent because you can't
pay your bills or threaten to do so, hoping to scare you and widen their
profit margins. All these debt collection companies are driven by greed
and so their salesmen know that they have to hit their sales targets.
All the activities just described are illegal, yet the law appears to
be indifferent. Dealing with the demands of Wescot Credit Services debt
collection agents can put a real strain on you.
You must ensure that you know whether or not the debt collecting firm
has bought the debt for themselves as a means of turning a profit (in
the role of a debt purchasing firm) or whether they are doing recovery
work on behalf of a client company such as a credit card issuer or a
bank (where they would pocket a proportion of recovered funds in commission).
If a letter of assignment has been sent, which the law requires when
the debt has been sold wholesale, then you know that the debt collection
firm is the actual owner of the debt and will try to get as much out
of you as they can. When dealing with Wescot Credit Services debt collection
agents do bear in mind that every penny the collections agency gets
is profit as they purchased the debt outright. So he will try to break
you any way he can.
Certainly, some debt purchasing companies are much worse than the
rest. Some have a speciality in writing tentative letters about hypothetical
debt to people saying that they owe money when in fact they know full
well they owe nothing at all. This works well for the debt collection
companies because they're well aware that a certain number of folk always
capitulate when bullied even though they realize full well that they
owe nothing at all. The least honest of these debt purchasing firms
compile inventories of debts which are often more than six years old
and try to make money from them. This is totally illegal. These debts
are Statute Barred, and their recovery cannot be legally enforced.
So ask Wescot Credit Services Debt Collection Agents
for a copy of the original contract when you took out your loan or credit
card.
Even better, start
an unenforceable
credit agreement application here. If you want to check, in addition,
missold PPI and recover all the credit card charges you've paid over
the last 6 years (plus 8% interest) it costs an upfront fee of only
£99 for a full audit to see what you're entitled to. Click
