Wescot Credit Services Debt Collection Agency and
the Truth About Your Debt

You should always make sure you know whether or not the debt collector
has bought the account themselves as a means of turning a profit (as
a debt purchasing company) or whether they are merely carrying out this
nefarious task on behalf of another company such as a credit card issuer
or a bank (where they would pocket a percentage of recovered money).
If you are sent a letter of assignment, which the law requires when
the debt has actually been sold wholesale, then you know the debt collection
agency is the owner of the account and will attempt to get as much out
of you as they are able. When dealing with Wescot Credit Services debt
collection agency remember that almost everything the agency gets is
pure profit as they bought the account wholesale. So they will try to
break you any way they can.
They might ask you for your mobile phone number if you have one and
most people do have one. But you should not give it to them. Because
if you do they will be able to pester you at work and at home at all
times of the day and night. They will continue to do this even after
you ask them to stop, so you must put it in writing, and preferably
send the letter by recorded delivery so that it is signed for as proof
of delivery (the problem is that so many operate from a PO box number
so a signature is impossible to obtain). Some of the most disreputable
debt collectors will contact the people who live next door to you and
talk to them about your debt. The worst may tell your kids that you
are bad or threaten this, in the hope that they will be able to increase
their profit margins. All such debt collecting firms are purely profit
driven and so their sales force know that they have to reach their targets.
All the things just described are unlawful, yet the law seems to be
indifferent for some reason. Managing the demands of Wescot Credit Services
debt collection agency can be extremely worrying.
If you are coping with Wescot Credit Services debt collection agency
you may be reassured that a lot of the actions that they are using to
harass you are probably unlawful. The debt collecting firms or DCAs
do not seem to be obliged to do anything about improving their working
practices unless ordered to do so by the Office of Fair Trading or similar
organisation.
It is an option to question the validity of the money owed by making
a Subject Access Request (sar) as a foil to Wescot Credit Services debt
collection agency. The true owner of the account (the bank or the DPC)
is obliged to send you a true signed copy of your original credit agreement
if the contract was made before April 6th 2007. If they fail to do this
they are breaking the Consumer Credit Act, and the debt is then said
to be in dispute. For as long as the debt is in dispute they must not
ask you for any money (if they do so they are breaking the law again)
and they cannot sell it on (which many do at this stage). While this
situation exists it is unenforceable, even by a judge. There's a series
of pre-written letters available for this purpose. You can get a solicitor
to do this for you, because it can be a strain doing it all by yourself.
There are also legal firms who offer services in this area.
So ask Wescot Credit Services Debt Collection Agency
for a copy of the original contract when you took out your loan or credit
card.
Even better, start
an unenforceable
credit agreement application here. If you want to check, in addition,
missold PPI and recover all the credit card charges you've paid over
the last 6 years (plus 8% interest) it costs an upfront fee of only
£99 for a full audit to see what you're entitled to. Click
here for more.
To find out if you
qualify for an IVA or can benefit from a debt management programme,
try the IVA
Test. It's free to apply, and again you are protected by the consumer
laws regarding debt management at all stages. Click
here to go to the application form.
